NO PURCHASE NECESSARY TO ENTER OR WIN. OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES, THE DISTRICT OF COLUMBIA, CANADA (INCLUDING THE PROVINCE OF QUEBEC) AND THE UNITED KINGDOM, 18 YEARS OF AGE AND OLDER, PRESENT IN ONE OF THE ABOVE STATED JURISDICTIONS AT THE TIME OF ENTRY. THIS SWEEPSTAKES SHALL BE CONSTRUED AND INTERPRETED UNDER THE LAWS OF THE UNITED STATES. VOID WHERE RESTRICTED OR PROHIBITED BY LAW.
DESCRIPTION/ENTRY PERIOD/ELIGIBILITY: NO PURCHASE NECESSARY. Purchase will NOT increase your chance of winning. The Digicel International: “Click to Win” Sweepstakes (the “Sweepstakes” or “Prize Draw”), is open to legal residents of the 50 United States, the District of Columbia (“US Entrants”), Canada including the Province of Quebec (“CA Entrants”), and the United Kingdom (“UK Entrants”), who are 18 years of age or older at time of entry (collectively “Eligible Entrant(s)”). The Sweepstakes begins at 12:00:00 PM (“Noon”) Eastern Daylight Time (EDT) [USA], (equivalent to 4:00:00 PM Greenwich Mean Time (GMT)) on Monday, November 16th, 2020 and will end at Noon EDT [4:00:00 PM GMT] on Sunday, January 17th, 2021 (the “Sweepstakes Period”). Individuals employed by or otherwise associated with employees of Diaspora Talktime, Inc./Digicel International(the “Sponsor”), its affiliates, distributors, subsidiaries and individuals of promotional partners, prize providers, agencies including Marden-Kane, Inc. (the “Administrator”) (collectively the “Released Parties”); and, their immediate families (spouse, parents, children, siblings and their respective spouses) and persons living in the same household of each are not eligible to enter or win a prize. The Sweepstakes will be divided into nine (9) weekly entry periods (each, an “Entry Period”), as detailed in the Drawing Schedule (the “Chart”) below.
HOW TO ENTER: There are two ways to enter the Sweepstakes:
1) Automatic Entry With Purchase: Each time an entrant completes one of the qualifying transactions via an authorized agent, the website at digicelinternational.com, or the Digicel International App using a participating product to a registered Digicel phone number as further detailed below per participating country, the entrant will automatically receive one (1) entry (the “Entry”) into the Entry Period/random drawing that corresponds to the date of their transaction (a “Qualifying Transaction”).
a. For US Entrants: Participating products include Top Up/Plans; Bill Pay; Call International; Send Money; and Digital Cards. Any amount sent from the US to a registered Digicel phone number (located in Anguilla, Antigua, Aruba, Barbados, Bermuda, Bonaire, BVI, Cayman Islands, Curacao, Dominica, El Salvador, French Guiana, Grenada, Guadeloupe, Guyana, Haiti, Jamaica, Martinique, Montserrat, Panama, St. Kitts, St. Lucia, St. Vincent, Suriname, Trinidad or Turks and Caicos) will be eligible to receive an entry.
b. For CA and UK Entrants: Participating products include Top Up/Plans and Send Money. Any Top Up amount or money sent from CA and the UK, to a registered Digicel phone number anywhere in the world will be eligible to receive an entry.
2) Email Entry Without Purchase: To enter the Sweepstakes without completing a Qualifying Transaction, send an email to: DigicelPromos@gmail.com and in the body of your email include your complete name, home address, phone number and age. The subject line must read “Digicel International [insert appropriate country of sender US, CA or UK] Entry: “Click to Win” Sweepstakes. To be valid, each Email No Purchase Entry must contain all of the required information requested above. The Sponsor is not responsible for late, lost, incomplete, illegible, or misdirected mail or emails. Proof of e-mailing does not constitute proof of delivery. Upon receipt of a valid email, the entrant will receive one (1) Entry into the Sweepstakes for the Entry Period/random drawing that corresponds to the receipt date of their Email Entry.
CONDITIONS OF ENTRY: All material submitted becomes the sole property of Sponsor and will not be acknowledged or returned. There are no limits to the number of qualified Automatic Entry with Purchase, or Email No Purchase Entries received per person, per Country, per Entry Period. Entries generated by script, macro or other automated means and Entries by any means which subvert the entry process are void. Incomplete or inaccurate Entries are void. You may only use one (1) email address to enter the Sweepstakes. Each qualified/eligible Automatic and Email No Purchase Entry submitted will be entered into the appropriate Entry Period drawing per Country, per the dates noted in the Drawing Schedule below. All entries received in one Entry Period will not be carried over into a subsequent Entry Period.
By entering, entrants acknowledge compliance with these official rules, including all the eligibility requirements. Sponsor and Administrator are not responsible for lost, late, incomplete, invalid, unintelligible, delays or inaccuracies in processing Qualifying Transactions (as detailed above per Country) due to computer error or malfunction. Sponsor is not responsible for incorrect or inaccurate transcription of entry information, human, printing or other errors, technical malfunctions, or any other error or malfunction. In the event of a dispute as to any Entry, the authorized email account holder of the email associated with the Email No Purchase Entry or, the registered account holder of the Digicel phone number used to process the relevant valid Transaction, will be deemed to be the entrant and he/she must comply with these Official Rules. A potential winner may be required to show proof of being the authorized account holder of the email account or registered Digicel phone number associated with the Entry. In the event that this Sweepstakes is cancelled, Sponsor reserves the right to conduct a random drawing to award prizes from among all eligible, non-suspect entries received prior to the time of the action or event warranting such cancellation. A transaction-based entry will not increase your chances of winning.
DRAWING SCHEDULE AND ODDS OF WINNING: There will be a total of nine (9) Weekly Entry Periods (each an “Entry Period”) and a total of twenty-seven (27) random drawings conducted (one-1 per Entry Period/per participating country) from all qualified/eligible entries received by the deadline date for each Entry Period, as outlined in the Drawing Schedule and Prize Chart (the “Chart”) below. Each random drawing will be held on or about the drawing dates noted below at approximately Noon (EDT) (4:00:00 PM GMT), by the Sponsor under the supervision of a representative of the Administrator, Marden-Kane, Inc. an independent judging organization, located at 575 Underhill Blvd., Suite 222, Syosset, New York, USA, whose decisions are final on all matters relating to this Sweepstakes. Odds of winning depend upon the number of eligible (purchase and no purchase) entries received per country, during each Entry Period.
PRIZES: A total of maximum of one thousand five hundred and seventy five (1,575) prizes are available to be won as detailed above and as further described herein: Prizes will be awarded per Entry Period as described below and as indicated in the chart above. When an Eligible Entrant completes a Qualified Transaction or sends an Email Entry* they will be entered into the Sweepstakes for a chance to win the actual Qualified Transaction amount associated with their winning entry, subject to the following restrictions:
· The prize amount for winners who sent in a Qualified Transaction, will have a minimum and a maximum pay out amount, (regardless of the actual Transaction amount on the winning entry).
· The prize ceiling (maximum) and the prize floor (minimum) amounts varies per country, as follows:
o a US winner cannot receive a prize under $20 (the minimum amount) or over $500 the maximum amount.
o a CA or UK winner cannot receive a prize under $20 (the minimum amount) or over $200 the maximum amount.
o *all Email Entries without Purchase Winners will receive the advertised maximum payout amount per their respective country (US $500; CA $200 and UK $200).
· Current Minimum/Maximum Prize amounts for all participating countries will be in USD. US: $20/$500; CA: $20/$200; and UK: $20/$200.
· Total value of all Prizes offered in the Sweepstakes: $27,900 (US: $13,500; CA: $7,200 and UK: $7,200)
· There is a limit of one-1 prize per person, per week.
PRIZE RESTRICTIONS: Prizes (minimum/maximum quantities detailed above) are available to be won provided that a sufficient number of eligible entries have been received per country to conduct each of the Prize Drawings. Each winner will receive an Ecode/Gift Card issued by the Sponsor in the amount of the prize won in USD. Ecodes/Gift Cards are subject to the Terms and Conditions printed thereon or on issuers corresponding website. Restrictions may apply. Prizes cannot be transferred for value or redeemed for cash and no substitutions allowed except at the discretion of the Sponsor. All taxes on a prize won, and other expenses related to accepting the prize are the sole responsibility of the winner or parent/legal guardian if winner is a minor in his/her jurisdiction of residence.
WINNER NOTIFICATION AND PRIZE REDEMPTION: Randomly selected eligible entrants (the “Potential Winners”) will be notified via email by Digicel on/about the notification dates noted in the Notification Schedule below. Shortly thereafter the Potential Winner will receive a second email from the Administrator via Digicel@mkpromosource.com. This email will request that each Potential Winner follow the instructions provided to claim their prize within 14 days of receipt of the Administrator’s notification email. Information required will include (but not limited to): First and Last Name, Email address, Phone number and certifying that they are 18 years of age or older and have read the Official Rules. Once the claim process is complete the winner will automatically receive a gift card link and instructions on how to access and activate their Ecode/Gift Card. If a Potential Winner cannot be reached or does not respond within specified time frame, is found to be ineligible, or declines to accept the prize, the Potential Winner may be disqualified in Sponsor’s sole discretion, and in such case Sponsor may select an alternate Potential Winner in a random drawing from remaining eligible entries. Only one (1) alternate drawing will be held for each Entry Period/country, after which the prize or prizes will remain un-awarded.
GENERAL RULES: By entering this Sweepstakes, entrants from the U.S., Canada and the UK except where prohibited by law, and if a minor in his/her jurisdiction (their parent/legal guardian for himself/herself and on behalf of the minor) consent to release and hold harmless the Released Parties which includes the Sponsor, its parent company, their affiliates, subsidiaries, partners, agencies and their respective employees, directors, officers, shareholders, agents, successors and assigns, from and against any and all claims, actions, demands, liabilities, damages, injuries, losses and costs, expenses and damages of any kind including without limitation punitive, incidental, consequential damages, that may result from participation in the Sweepstakes or acceptance/receipt/use/misuse of a prize, and agree to be bound by the Official Rules and the decisions of the Sponsor and/or Sponsor’s representatives, which are final. Nothing shall exclude the Sponsor’s liability for death or personal injury as a result of its negligence or generally for intent as well as for gross negligence. By entering, entrants (and their parents/legal guardians if entrant is deemed a minor in his/her jurisdiction of residence), release all rights to bring (and covenant not to bring) any claim, action or proceeding of any kind or nature whatsoever against Sponsor, except where the Sponsor is liable for death or personal injury as a result of its negligence or generally for intent as well as for gross negligence. By accepting a prize, entrants (and if a minor in his/her jurisdiction, their parent/legal guardian for himself/herself and on behalf of the minor) grant permission to use their name, address (city, state, country), photos, descriptions of their person, likeness, statements, and biographical information without limitation, for advertising and publicity purposes, worldwide in any media known to date or to be developed in the future, without further compensation or notice, except where prohibited by law. Sponsor, all promotional agencies, prize providers, affiliates, agents and representatives are not responsible for any lost, stolen or otherwise unaccounted for entries that may arise from technical errors in hardware and software programs and or misdirected, illegible, postage due or damaged entries. The official rules for this Sweepstakes, excluding any and all disputes, are subject to all applicable US Federal, state, and local laws & regulations. Entrants further agree that any and all disputes shall be filed and resolved exclusively by the courts in the State of Florida, USA.
PRIVACY & PERSONAL INFORMATION: Personal information collected from entrants shall be stored in the US and will be used by Sponsor for the purpose of administering the Sweepstakes and if entrant authorizes by opting in, to provide entrants with information relating to products, services and promotions of Sponsor and affiliates of Sponsor. Sponsor shall not sell, share or otherwise disclose personal information of entrants with third parties, other than to third parties engaged by Sponsor to fulfill the above purposes or as otherwise consented to by the entrant or parent or legal guardian of any entrant who is a minor in the residence of his/her jurisdiction. ADDITIONAL RULES FOR CANADIAN RESIDENTS: Canadian winners will be required to correctly answer a mathematical skill question administered via the prize notification/redemption email, at the Sponsors sole discretion, prior to awarding of a prize.
QUEBEC RESIDENTS: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping parties reach a settlement.
OFFICIAL RULES AND WINNERS LIST: The Official Rules will be posted at www.digicelinternational.com. The name of the confirmed Prize Winners will be posted at www.digicelinternational.com after the Winners have been verified and will remain posted for 30 days thereafter.
